MGA: 30-Day Notice for Material Outsourcing, Prior Approval for Critical Services

The Malta Gaming Authority (MGA) has issued a reminder to gambling licensees regarding outsourcing procedures.

Compliance Requirements for Outsourcing Activities

Licensees must navigate regulations outlined in the Policy for Outsourcing by Authorised Persons, as stipulated by the Gaming Authorisations and Compliance Directive.

Material Supplies Notification

The MGA requires licensees to notify them within 30 days of outsourcing material supplies. This notification process can be completed through the "Operational – Outsourcing Arrangements" application on the Licensee Portal.

Prior Approval for Critical Services

For outsourcing activities classified as critical supplies or critical services, prior approval from the MGA is mandatory. This approval must be obtained before finalizing any agreements with the third-party provider.

Key Function and Shared Conduct Agreements

  • Applications for outsourcing key functions should be submitted by the relevant Key Person directly through the "Personal Portfolio" section of the Licensee Portal.
  • A separate process exists for obtaining formal MGA approval for outsourced business arrangements with third parties, known as "Shared Conduct Agreements."

By adhering to these procedures, licensees ensure compliance with MGA regulations and maintain a smooth relationship with the regulatory body.
